Welcome to PolarRide! These Terms of Service ("Terms") govern your use of the PolarRide mobile application and services (the "Platform"). By accessing or using PolarRide, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
1. Definitions
"Platform" refers to the PolarRide mobile application and all related services.
"User," "you," or "your" refers to any individual or entity using the Platform.
"Host" refers to users who list vehicles (cars, yachts, etc.) or services (drivers) on the Platform.
"Renter" refers to users who book vehicles or services through the Platform.
"Driver" refers to professional chauffeurs offering driving services.
"Booking" refers to a confirmed reservation of a vehicle or driver service.
2. Eligibility
To use PolarRide, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts
- Possess a valid government-issued ID
- For renters: Hold a valid driver's license (for vehicle rentals)
- For hosts: Own or have legal authority to list the vehicle/service
- For drivers: Hold a valid commercial driver's license and required certifications
By using the Platform, you represent and warrant that you meet all eligibility requirements.
3. Account Registration and Verification
3.1 Account Creation
- You must create an account to use Platform services
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized account access
3.2 Identity Verification
All users must complete identity verification, which includes:
- Government-issued ID verification
- Selfie verification
- Driver's license verification (for renters and drivers)
- Vehicle documentation verification (for hosts)
- Background checks (as applicable)
4. Platform Services
4.1 Vehicle Rentals
For Renters:
- Browse and book available vehicles
- Choose rental duration, insurance options, and delivery preferences
- Complete payment through secure channels
- Inspect vehicle before and after rental period
- Return vehicle on time and in agreed-upon condition
- Report any issues or damage immediately
For Hosts:
- List vehicles with accurate descriptions and photos
- Set pricing, availability, and rental terms
- Maintain vehicles in safe, roadworthy condition
- Provide valid insurance and registration
- Respond promptly to booking requests
- Conduct vehicle inspections with renters
4.2 Driver Services
For Customers:
- Book professional drivers by the hour or day
- Specify pickup location, destination, and duration
- Communicate trip requirements clearly
For Drivers:
- Maintain valid driver's license and certifications
- Provide professional, courteous service
- Follow all traffic laws and safety regulations
- Maintain availability calendar accurately
4.3 Yacht Charters
- Browse and book available yachts for water excursions
- Comply with all maritime safety requirements
- Follow captain's instructions and boat rules
- Hosts must maintain valid maritime certifications and insurance
5. Booking and Payment
5.1 Booking Process
- Bookings are confirmed upon successful payment
- You will receive a booking confirmation via email and in-app notification
- All booking details, including dates, times, and pricing, are binding once confirmed
5.2 Pricing and Fees
- Hosts set their own base prices
- PolarRide charges a service fee (typically 3-15% depending on service type)
- Additional fees may include: insurance, delivery, VAT, and booking fees
- Security deposits may be required and are fully refundable if no damage occurs
- All prices are in Nigerian Naira (₦) unless otherwise stated
5.3 Payment Methods
- We accept credit/debit cards and bank transfers via Paystack and Flutterwave
- Payment information is processed securely and encrypted
- You authorize us to charge your payment method for all fees
5.4 Cancellation and Refunds
Cancellation by Renter:
- Free cancellation: 48+ hours before pickup (full refund minus processing fees)
- 24-48 hours before pickup: 50% refund
- Less than 24 hours: No refund
Cancellation by Host:
- Hosts who cancel confirmed bookings may face penalties
- Renters receive full refund for host cancellations
- Repeated cancellations may result in account suspension
6. Insurance and Liability
6.1 Insurance Coverage
- All vehicle rentals include basic or comprehensive insurance
- Basic insurance: Covers third-party liability
- Comprehensive insurance: Covers vehicle damage, theft, and third-party liability
- Insurance does not cover: reckless driving, DUI, unlisted drivers, or policy violations
6.2 Damage and Loss
- Renters are responsible for any damage beyond normal wear and tear
- Report all accidents and damage immediately
- Security deposits may be used to cover repair costs
- Renters may be liable for costs exceeding insurance coverage
6.3 Limitation of Liability
PolarRide is a platform connecting users. We are not liable for:
- Quality, safety, or legality of listed vehicles/services
- Accuracy of listings or user information
- Actions or omissions of users
- Personal injury, property damage, or other losses during rentals or services
7. User Conduct
You agree NOT to:
- Violate any laws or regulations
- Use the Platform for illegal purposes
- Provide false or misleading information
- Impersonate another person or entity
- Harass, threaten, or abuse other users
- Share login credentials with others
- Attempt to circumvent Platform fees
- Use vehicles for commercial purposes without authorization
- Drive under the influence of drugs or alcohol
- Sublease vehicles without host permission
- Tamper with or disable GPS tracking devices
8. Intellectual Property
- PolarRide owns all Platform content, trademarks, logos, and intellectual property
- You may not copy, modify, distribute, or reverse-engineer Platform components
- User-generated content (photos, reviews) may be used by PolarRide for promotional purposes
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
10. Termination
- You may terminate your account at any time via app settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, you remain liable for outstanding fees and obligations
11. Dispute Resolution
11.1 Informal Resolution
Contact our support team to attempt resolution before pursuing legal action.
11.2 Arbitration
Any disputes will be resolved through binding arbitration in Lagos, Nigeria, in accordance with Nigerian law.
11.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
